Actor Jamie Foxx is facing a lawsuit from a woman who claims he sexually assaulted her at a restaurant in New York City eight years ago. The accuser alleges that Foxx groped her after she asked to take a photo with him. She is suing him for damages, citing "sexual assault, abuse, assault, and battery." Foxx's representatives have not yet responded to the allegations. According to the lawsuit, the assault took place at Catch NYC at around 1 am on August 26, 2015, after the woman was seated near Foxx. The lawsuit further states that Foxx appeared intoxicated and complimented the woman's appearance, leading her to a secluded area where he touched her without consent. The incident ended when her friend intervened. The lawsuit also seeks damages from the restaurant owner, Mark Birnbaum, claiming that he and the restaurant's staff failed to protect the plaintiff. The woman alleges severe emotional distress and other damages as a result of the assault. The lawsuit comes just before the New York Adult Survivors Act, which allows victims of sex crimes to sue after the statute of limitations has expired, expires on November 24th. Notably, other public figures such as Donald Trump, Sean Combs, Bill Cosby, Cuba Gooding Jr, and Russell Brand have also been sued under this act. Jamie Foxx, whose real name is Eric Marlon Bishop, won an Academy Award for Best Actor for his portrayal of Ray Charles in the 2004 film Ray.
